But there’s a deeper truth, rarely acknowledged out loud: every time a jury sits, it is not only the defendant on trial, but also the law itself.

What the System Says

Officially, a jury’s task is simple. The judge tells them what the law is, the jury weighs the evidence, and then they return a verdict of guilty or not guilty. The law is supposed to be beyond question. Judges will often warn jurors against “sympathy” or “conscience” leading them astray.

What Actually Happens

In practice, juries have a power that no judge can remove: they can acquit even when the evidence clearly shows the law has been broken. This is called jury equity or jury nullification. Jurors cannot be punished for their verdicts, and their reasoning is never scrutinised.

This principle is centuries old.

Bushell’s Case (1670): William Penn and William Mead were tried for unlawful assembly. The jury refused to convict despite heavy pressure from the judge. When jurors were fined and imprisoned for their defiance, the higher courts ruled they could not be punished. It established once and for all that a jury’s verdict is sovereign.

Clive Ponting (1985): A civil servant who leaked documents about the Falklands War was acquitted by a jury even though the judge instructed there was no legal defence. The public interest weighed heavier than the black letter of the law.

The Colston Four (2022): Protesters who toppled the Edward Colston statue in Bristol were acquitted of criminal damage, despite the act being on film. The jury decided that applying the law in that context would itself be unjust.

The Recent Ricky Jones Case

The same principle has just been seen again. Ricky Jones, charged under laws meant to restrict “dangerous speech,” was acquitted by a jury even though there was recorded evidence of him making inflammatory threats. The verdict shocked many, but it also confirmed something vital: jurors are not bound to rubber-stamp the state’s use of its laws.

The acquittal effectively tests the law itself. If a jury of ordinary people refuses to convict, it raises the question of whether the law, or its application, commands the consent of the public. In a democracy, that matters more than any government directive.

Why It Matters

Every acquittal on grounds of conscience is a reminder that the law must not only exist on paper but also carry legitimacy in the hearts of ordinary people. Without that legitimacy, laws collapse under their own weight.

This principle should not be romanticised — it can cut both ways. Some may see jury equity as dangerous inconsistency. But it is also the last safeguard against unjust or politically motivated prosecutions. When Parliament writes new offences, it does so knowing that sooner or later, the law will face its toughest exam: twelve citizens in a jury room, free to say no.

A Quiet Balance of Power

In the UK, juries hold a hidden constitutional role. They do not simply decide guilt; they pass judgment on whether the law itself is just when applied to real lives. That balance of power is rarely spoken of, but it may be one of the strongest defences of liberty left in Britain today.

Hope isn’t what they promise you.
